1. Acceptance of Terms

By accessing or using Lyrigo ("the Service," "we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

We reserve the right to modify these terms at any time. Your continued use of the Service after changes are posted constitutes your acceptance of the modified terms.

2. Description of Service

Lyrigo is an interactive language learning platform that helps users improve their foreign language skills through music. The Service integrates with music streaming platforms to provide an engaging, personalized learning experience.

Core Features

• Music Integration: Connect Apple Music or Spotify for playback and catalog access
• Learning Modes: Listen & Learn, Dictation, and Trivia modes
• AI-Powered Tools: Translations, annotations, and vocabulary analysis
• Vocabulary Management: Save and practice words from songs
• Progress Tracking: Analytics, session history, and learning goals

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account
• Not create multiple accounts or share your account with others

You must be at least 13 years old to create an account. Users under 18 must have parental consent.

4. Subscription and Payment

Subscription Tiers

We offer two tiers:

• Free: Up to 5 listening sessions per day. Limited trial access to Dictation and Trivia modes (3 trials each, lifetime).
• Pro ($5.99/month or $39.99/year): Unlimited access to all features including listening sessions, Dictation, Trivia, Search, Artist Pages, Word Games, Vocabulary Saving, Word Lookup, AI Annotations, Favorites, and Fix Sync. Includes a 7-day free trial for new subscribers.

Payment Terms

• Subscriptions are billed monthly or annually in advance
• Payments are processed through Lemon Squeezy (web), the Apple App Store (iOS), or the Google Play Store (Android)
• All fees are non-refundable except as required by law or the applicable app store refund policy
• You authorize us to charge your payment method for all fees incurred
• Prices are subject to change with 30 days' notice

Cross-Platform Subscriptions

You may subscribe via the web (Lemon Squeezy), the iOS app (Apple App Store), or the Android app (Google Play Store), but not on multiple platforms simultaneously. If you have an active subscription on one platform, you must cancel it before subscribing on another. Your subscription status is shared across all platforms.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until the end of the billing period. For subscriptions purchased through the Apple App Store, cancellation must be managed through your Apple ID settings. For subscriptions purchased through the Google Play Store, cancellation must be managed through your Google Play subscription settings.

5. Music & Video Integration

The Service uses YouTube's embedded player (via the YouTube IFrame Player API) for music video playback during learning sessions:

• Music videos are streamed via the official YouTube embedded player and are never downloaded or stored on your device
• The YouTube video player is always visible on screen during playback, in compliance with YouTube's Terms of Service
• Your use of YouTube content is subject to the YouTube Terms of Service and Google Privacy Policy
• We are not responsible for the availability, quality, or content of videos provided by YouTube
• YouTube is a trademark of Google LLC

6. User Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Share, sell, or redistribute your account access
• Abuse, harass, or harm other users
• Upload or transmit viruses or malicious code
• Circumvent any content protection or security measures
• Use the Service to create competing products or services

7. Intellectual Property

Our Content

The Service, including its design, features, functionality, and all content (except user content and third-party content) is owned by Lyrigo and protected by copyright, trademark, and other intellectual property laws.

User Content

You retain ownership of content you create (vocabulary lists, saved words, session data). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely to provide the Service.

Third-Party Content

Music, lyrics, and related content are owned by their respective copyright holders. We do not claim ownership of any third-party content. All music playback is facilitated through licensed streaming services.

8. AI-Generated Content

The Service uses OpenAI's language models to generate translations, annotations, vocabulary definitions, dictation exercises, and quiz content. When you use AI-powered features, relevant song lyrics and words are sent to OpenAI for processing:

• AI-generated content is provided for educational purposes only
• Your data is sent to OpenAI solely to generate learning content and is not used to train AI models
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content
• You should verify important information with authoritative sources
• AI models may occasionally produce inaccurate or inappropriate content
• By using AI-powered features, you consent to this data processing as described in our Privacy Policy

9. Disclaimers and Limitations of Liability

Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Guarantee of Results

We do not guarantee that the Service will help you achieve language fluency or any specific learning outcomes. Learning results vary based on individual effort, aptitude, and usage.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYRIGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.

10. Third-Party Services and Links

The Service integrates with and links to third-party services:

• YouTube (Google LLC) for music video playback via the IFrame Player API
• OpenAI for AI-powered learning features (dictation, trivia, vocabulary analysis, annotations)
• Lemon Squeezy for web payment processing
• Apple App Store for iOS in-app purchases
• Google Play Store for Android in-app purchases
• PostHog for product analytics
• RevenueCat for subscription management

We are not responsible for the content, policies, or practices of third-party services. Your use of third-party services is subject to their respective terms and conditions.

11. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

By using the Service, you consent to our collection and use of your data as described in our Privacy Policy.

12. Termination

By You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

By Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms and Conditions
• Your account shows signs of fraudulent activity
• You fail to pay required fees
• We are required to do so by law
• We decide to discontinue the Service

Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account data within a reasonable timeframe. Provisions that should survive termination (including disclaimers, limitations of liability, and dispute resolution) will remain in effect.

13. Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at admin@lyrigo.com to resolve the issue informally.

Governing Law

These Terms are governed by the laws of the jurisdiction where Lyrigo is registered, without regard to conflict of law provisions.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

14. Changes to the Service

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Change features, functionality, or pricing with reasonable notice
• Impose limits on certain features or restrict access to parts of the Service

We will make reasonable efforts to notify you of significant changes, but we are not liable for any modifications or discontinuation of the Service.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lyrigo regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or internet service failures.
